Our commitment to your privacy
free energy drink Australia Pty. Ltd. ("Free Energy", "we", "us" or "our") is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy describes how we collect, hold, use and disclose your personal information when you visit or make a purchase from free-beverage.com.au (the "Site"), and how you can access or correct that information, or make a complaint.
Personal information we collect
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies installed on your device. As you browse the Site, we also collect information about the individual pages or products you view, what site or search terms referred you to us, and how you interact with the Site. We refer to this as "Device Information".
When you make a purchase or attempt to make a purchase through the Site, we collect information such as your name, billing address, shipping address, payment information, email address, and phone number. We refer to this as "Order Information". When we talk about "Personal Information" in this policy, we mean both Device Information and Order Information.
How we collect personal information

- Log files that track actions on the Site and collect data including your IP address, browser type, internet service provider, referring/exit pages, and date/time stamps.
- Web beacons, tags and pixels — electronic files used to record how you browse the Site.
How we use your personal information
We use Order Information generally to fulfil orders placed through the Site — processing payment, arranging shipping, and providing invoices or order confirmations. We also use it to:
- communicate with you about your order;
- screen orders for potential risk or fraud; and
- where you have consented, provide you with information or advertising about our products.
We use Device Information to help screen for risk and fraud, and to improve and optimise the Site — for example, by generating analytics about how customers browse the Site, and assessing the performance of our marketing.
Sharing your personal information
We share Personal Information with trusted third parties who help us operate the Site and our business, for the purposes described above. For example:
- Shopify powers our online store — see shopify.com/legal/privacy.
- Google Analytics helps us understand how customers use the Site — see google.com/intl/en/policies/privacy or opt out here.
We do not sell your Personal Information. We may disclose it where required to comply with applicable Australian law, to respond to a subpoena, search warrant or other lawful request, or to otherwise protect our rights.
Overseas disclosure
Some of the third parties we use to operate the Site — including Shopify and Google — store or process data on servers located outside Australia, including in the United States. Free Energy is also affiliated with free beverage GmbH & Co. KG, our manufacturing partner in Germany, and some information may be shared with that entity for order fulfilment and quality purposes. Before disclosing Personal Information overseas, we take reasonable steps, consistent with Australian Privacy Principle 8, to ensure the recipient handles it in a manner consistent with the APPs, including relying on the recipient's own published privacy commitments where applicable.
Behavioural advertising
We may use your Personal Information to provide targeted advertising or marketing we believe may interest you. You can learn more about how this works at the Network Advertising Initiative's educational page: networkadvertising.org. You can opt out of targeted advertising directly with:

Data security & retention
We take reasonable technical and organisational steps, consistent with Australian Privacy Principle 11, to protect the Personal Information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. When you place an order, we retain your Order Information for as long as necessary to fulfil the purposes described in this policy, meet our legal and accounting obligations, and resolve disputes — after which it is securely deleted or de-identified.
Access and correction
Under Australian Privacy Principles 12 and 13, you have the right to request access to the Personal Information we hold about you, and to ask that it be corrected if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details below — we will respond within a reasonable period, and will not charge a fee for a straightforward access request.
Complaints
If you have a concern about how we have handled your Personal Information, please contact us first using the details below so we can investigate and try to resolve it directly. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.
European residents
Free Energy's manufacturing partner, free beverage GmbH & Co. KG, operates in Germany. If you are a resident of the European Economic Area, you also have the right to access, correct, or ask us to delete the personal information we hold about you under the General Data Protection Regulation (GDPR). We process EU residents' information to fulfil contracts (for example, an order placed through the Site) or to pursue our legitimate business interests as described above. Your information may be transferred outside the EEA, including to Australia and the United States.
Changes to this policy
We may update this Privacy Policy from time to time to reflect changes to our practices, or for other operational, legal or regulatory reasons. The "last updated" date at the top of this page reflects the most recent revision.
